I/We (hereinafter referred to as “Client”) have employed Walkies Cape Town (hereinafter referred to as “Walkies”) to provide the following services of walking their dog(s).
Payments are to be made to Walkies on a monthly basis, with the first given to Walkies on the day the services commence. Twenty-four hours advanced notice is required for cancellation and reimbursement will be made. If cancellation is made with less than twenty-four hours notice no reimbursement will be made. If Walkies must take legal action to collect any outstanding balances, and Client is found at fault, Client agrees to pay all costs, including attorney’s fees, to do so.
Description of Services: Client understands that Walkies will care for their animal(s) in their absence and this care may require access to their home(s). This care is valid only for animals and is not provided for persons. This animal care may include the following: feeding, providing water, walking, providing love and affection to their animal(s), treats, administering medications, providing emergency medical treatment, transportation, admittance to a veterinarians clinic or animal hospital, training, behavioral modification, and any other services which may be required to carry out the duties set forth herein. Walkies will make all reasonable efforts to provide for the safety and well being of their animal(s) but makes no guarantees that such efforts will be sufficient in all circumstances.
Responsibility/Release and Assumption of Risk: Client acknowledges that the Services offered may be an activity in which damage or injury to animal(s) and/or persons may occur. Client will assume full financial responsibility for the actions of their animal(s). Client understands and is aware that the Services described in this Agreement contain inherent risks and dangers which could result in injury and/or damage to and/or by Client’s animal(s), which may arise resulting from, but not limited to, the hazards of all types of traffic, dangerous dogs, dog attacks, injury to animals or persons, exposure to areas with novel or unfamiliar stimulus, all types of weather and/or unsafe conditions, the hazards of caring for injured, sick or elderly animals, the dangers of civil disturbance, the forces of nature, the negligent or reckless acts or omissions of, and/or the bankruptcy, insolvency or cessation of services by veterinarians, Walkies’ employees or it’s subcontractors.
In consideration of, and as part of the payment for the Services provided herein, Client has and does hereby expressly assume all of the above risks. The terms of this Agreement shall serve as a release and express assumption of risk for myself, my animal(s), my heirs, assignees, administrators, executors, and all members of my family, including any minors. I have read and fully understand the provisions and the legal consequences of this Release and Assumption of Risk and I hereby agree to all its conditions, especially noting and agreeing to the release of Walkies and its agents, employees, officers, directors, associates, affiliated companies, subcontractors, and related individuals to the extent permitted by law, from liability for injury or damage to or by our animal(s), and assume all risks thereof and full financial responsibility for the actions of my animal(s).
Severability: If any provision of this Agreement is deemed to be unenforceable for any reason, this will not affect the validity and enforceability of any other provision of this Agreement.
Termination: Either Client or Walkies has the right to terminate this Agreement at any time by notice to the other. Client acknowledges that Services will cease upon termination of this Agreement.
This Agreement supersedes all other agreements, written or oral, between Client and Walkies.
